By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our websites.
Force Majeure
If a Force Majeure event causing delay continues for more than 30 days, we may terminate this Agreement by giving at least 7 days notice to you. “Force Majeure” means any act, circumstance or omission over which we could not reasonable have exercised control.
Jurisdiction
These terms and conditions are to be governed by and construed in accordance with the laws of Queensland and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in Queensland and you agree to submit to the jurisdiction of those Courts.
If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary, the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.
Privacy
We undertake to take all due care with any information which you may provide to us when accessing our website and registration portal. However, we do not warrant and cannot ensure the security of any information you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
Our compliance with privacy legislation is set out in our separate Privacy Policy which may be accessed from our home page.
In the course of its business, Gardiner Chess routinely publishes results of competitions, rating lists of players and photos and videos of participating students. This information is typically used on the Gardiner Chess website. We may also do media releases and other public releases from time to time. Where students are specifically asked to pose for a photo or video, parental consent will be checked in accordance with permissions given (or not) via the iClassPro portal.
Gardiner Chess also gives consent for school chess coordinators to utilise photos and results from the Gardiner Chess webpage in school publications.
Where parents wish for names to be suppressed in event results, parents may advise via email to [email protected]. This is also passed on to the Queensland Junior Ratings Officer to keep names off the published rating list.

Whilst we have taken all due care in providing the information on our website, we do not provide any warranty either express or implied including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose.
To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded.
We also take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.

The copyright to all content on this website including applets, graphics, images, layouts and text belongs to us or we have a licence to use these materials.
All trademarks, brands and logos generally identified either with the symbols TM or © which are used on this website are either owned by us or we have a licence to use them. Any comment, feedback, idea or suggestion (called “Comments”) which you provide to us through this website becomes our property. If in future we use your Comments in promoting our website or in any other way, we will not be liable for any similarities which may appear from such use. School Chess Coaching
In order for your child to start a chess program with Gardiner Chess, an online enrolment form must be completed via our registration portal. Payment for the term is required at this time and can be made using a visa or mastercard.
If your child is joining part way through the term then a pro rata fee will be calculated based on the remaining number of weeks. Please call the Gardiner office on (07) 5522 7221 or email [email protected] to find out what the fee will be and what the process of enrolment will be.
Unless there are extended absences, where special allowance may be made on written request, we will require the full fee to be paid. The fee is based on a full class of students and no allowance can be made for occasional absences.
Term fees are based on a minimum of eight (8) lessons per term. Some terms may see 9 or 10 lessons depending on the number of weeks in the term. For term lengths (of coaching) that are less than eight (8) weeks, a pro rata rate will apply.
Under no circumstances will the coach be allowed to accept payment.
When enrolments are made, it is important that we are advised of any medical, custodial or other factors of which we need to be aware.
A condition of enrolment is that we be advised of any change in your contact details. These details can be updated online through the registration portal.
When lessons are scheduled after school we expect your child to be collected upon the completion of the lesson. We reserve the right to charge a late fee as follows;
$20.00 for 10-15 minutes after the scheduled end of the lesson,
An additional $20.00 for every 10 minutes more than 15 minutes late.
We reserve the right to any fees or charges associated with late payments. For example,
Chesskid Gold Membership will be withheld should payment for the term fee be later than 3 weeks.
For enrolments where students have been attending and not paid for later than 5 weeks into the term, a 10% administration fee may be applied.
If regular classroom lessons cannot be provided due to circumstances beyond our control, whether for a definite or indefinite period, we will provide online lessons. You will still be charged for these online lessons under normal rates, unless we advise otherwise.
We expect a level of behaviour within our chess classes, commensurate to the standards within the school classroom.
Where behaviour does not meet expectations, Gardiner Chess will inform parents and discuss with them the issue and potential solutions to the issue. All reasonable steps and requests are to be considered and worked towards by both sides.
Where there are ongoing behaviour issues, or serious behaviour breaches occur, Gardiner Chess reserves the right to remove a student from the program on a temporary basis.
Where necessary, Gardiner Chess reserves the right to remove a student from the program until the end of the term, or year as the case may be.
Should behaviour be the cause of removal from the program (even on a temporary basis), Gardiner Chess reserves the right to not provide a refund.
Gardiner Chess Weekend and Holiday Events Policy
Whilst Gardiner Chess voluntarily provides “play areas” for the use of younger chess players at various venues, these areas are not provided for the purposes of “child care” and their use is subject to the oversight of the parents or guardians of these younger chess players.
It is not the role of the Arbiters to “police” areas outside of the playing venue. Their role is to ensure that chess games are played in accordance with the rules and ensuring order in the playing venue.
Supervision of children outside of the playing hall is solely the responsibility of the parent or caregiver, not the Arbiter or the Organiser of the tournament.
In relation to junior chess tournaments the decisions made by the arbiter or organiser are final. When it comes to Open tournaments (involving adults and juniors), Gardiner Chess may appoint an appeals committee for any disagreements or anyone wishing to appeal a decision or action made by an official.
It is an expectation that any child or adult taking part in a Gardiner Chess event adhere to the expected behaviours outlined within our Event Behaviour Policy.
Where a participant shows significant signs of illness, we reserve the right to exclude that participant on the basis of health and safety grounds.
Event Behaviour Policy
Gardiner Chess expects every participant and their associated parents, care-givers and partners to exhibit respect to other participants, their associates and Gardiner Chess Officials.
Every player in a Gardiner Chess event, by virtue of their entry, acknowledges and accepts the following standards of behaviour and the consequences of any breach or breaches of those standards.
Every parent or care-giver, by virtue of their child’s participation in a Gardiner Chess event, acknowledges and accepts the following standards of behaviour and the consequences of any breach or breaches of those standards.
No player, parent, or care-giver shall engage in conduct that is violent, threatening, or demeaning of another player, parent, care-giver, commentator, or tournament official and where such conduct is engaged in a tournament official or Gardiner Chess employee shall, as appropriate:
Require the player involved to miss one or more rounds of the tournaments
require the person or persons or any number of them engaged in such conduct to forthwith leave the venue and take no further part in the tournament
report such conduct to the organiser;
report such conduct to the Chess Association of Queensland.
Call the police.
No appeal shall arise from the determination of the Arbiter.
All players, parents and care-givers shall respect all property and the venue and shall not engage in any conduct deleterious to the property or the venue, and where such conduct is engaged in the arbiter shall have those powers outlined in sub-paragraph 10d to deal with the perpetrator(s).
All players will follow the rules and regulations set out by Gardiner Chess, either those published in writing on the Gardiner Chess website, or spoken during announcements at the beginning of each tournament by the Chief Organiser/Arbiter. Where something is not covered specifically by Gardiner Chess, the World Chess Federation (FIDE) rules shall apply.
Where a Gardiner Chess tournament is approved by the Chess Association of Queensland (CAQ) an Appeals Committee shall be appointed to determine appeals from a decision of the Chief Arbiter in relation to the application of the Rules of Chess, but no appeal lies from a decision of the Arbiter with respect to any decision made in accordance with sub-paragraph 10d.
For the avoidance of doubt, threatening behaviour includes the use of words directed to any person at a Gardiner Chess event, and includes the use of swearing and gestures and includes threats made directly or by use of electronic means or social media.
Penalties for Behaviour Breaches
Further to item 10d, Gardiner Chess may exclude that person from future events as deemed appropriate, and;
May require that person, prior to acceptance into any future Gardiner Chess event, to post a sum of money with Gardiner Chess as a guarantee of adherence to the standards of behaviour. Such money will be refunded at the end of that next event where there has been no breach of the standards of behaviour by that person.
Gardiner Chess may report any matter to the Chess Association of Queensland and any further punishments may be determined by the Chess Association of Queensland in accordance with its constitution.
